They create a right to prior information for employees in SMEs in the event of a sale.
- For companies with fewer than 50 employees, Article 11 introducesa period of notice to employees prior to any sale of a business. This period is set at 2 months from notification by the owner of his intention to sell, to enable one or more employees of the company to submit an offer for the purchase of the business.
- Article 12 of thedraft law allows employees to be informed of any intention to sell shares or securities giving access to the majority of the capital, to enable them to submit a takeover bid.
