Draft “El Khomri” law

The preliminary draft of the “El Khomri” law aimed at instituting new freedoms and new protections for companies and working people was sent to the Council of State on the evening of February 17, 2016.

The text will be presented to the Council of Ministers on March 9 and examined on first reading by the National Assembly in early April and the Senate in May.

This bill covers many areas of labor law. Among the most emblematic measures are :

  • Greater flexibility in the 11-hour rest period, which can be split between employees on a fixed working day (if agreed collectively, at the employee’s request and with the employer’s consent) and in the event of on-call duty;
  • Revising the definition of economic redundancy ;
  • Direct access to fixed annual working days for companies with fewer than 50 employees;
  • Capping damages at the industrial tribunal: from 3 to 15 months;
  • Waiver by company agreement of the overtime premium rate set by the branch.
