Face au Droit Social #10: Social networks in the workplace: what does employment law say?

77% of French people are registered on at least one social network, and 9 out of 10 Internet users admit to having commented on their professional lives on these media. While some consider this to be a private space, others consider the “walls” of these platforms to be public places, and therefore subject to the same rules, in terms of confidentiality, defamation… As legislation on these issues is still in its infancy, judges are tempted to resolve cases on a case-by-case basis.

What’s the difference between the private and professional spheres? What can you write on a social network? What about comments posted outside working hours? What should employers do? How do you draw up a charter for the use of social networks?

Our employment law experts, Michael Hayat, Delegate for Social Affairs at Syntec Numérique, and Nicolas Sauvage, Partner at Reed Smith, answer your questions and give you advice on how to best manage your life on these digital channels!
