Three key areas for digital businesses
In its contribution to the Arcep consultation, Numeum makes recommendations to ensure a regulatory framework that supports business development while strengthening the digital single market.
The aim is clear: to give users complete freedom of technological choice.
This contribution, which you can consult by clicking on “Download” at the bottom of the page, makes three main points:
- Aligning the French and European frameworks: we insist on the need for perfect harmonization between the SREN law and the Data Act. Indeed, the French law anticipates several provisions of the European regulation, even though these are directly applicable. Such coherence is essential to avoid regulatory fragmentation and offer legal certainty to companies in their cloud projects;
- Promoting users “freedom of choice: measures facilitating the portability and interoperability of cloud services must protect users” rights while stimulating innovation on the European market;
- Reconciling regulatory clarity and flexibility: the acceleration of technological innovations – quantum mechanics, artificial intelligence, etc. – requires a clear, yet flexible, framework. – requires a clear, yet flexible framework. Numeum advocates the co-construction of rules between the industry and public authorities, in order to preserve the capacity for innovation of cloud players and their appropriation by the market.
This contribution also looks at issues such as the framework for switching fees, the special treatment to be given to SaaS services, and the importance of relying on existing European standards rather than carrying out ad hoc standardization work.
Since the beginning of the debates on the SREN law, Numeum has been defending its members. Our response to this pre-implementation consultation is part of this dyanmic.
